Kujt i Sherben Steriotipizimi i Gjyqsorit Shqiptar?

Në këtë fillim viti pasqyra e arritjeve dhe dështimeve të klasës politike, në mënyrë të bezdisshme tashmë për shumë shqiptarë, përvijohet me arritjet në pikëpamjen ndërkombëtare dhe me dështimet në procesin politik të zgjedhjeve. Edhe në momentet e një prag katastrofe natyrale politika nuk humbet rastin për të bërë qitjen e radhës. Dhe në fund, ‘pasi ujërat të qetësohen’ duhet që prokuroria dhe gjykata të gjejnë fajtorin. Është për tu çuditur se sa lehtë lakohen nga politika emrat e institucioneve që vendosin për fajësinë dhe pafajësinë, ndërkohë që kolegët e tyre në perëndim do tregoheshin shumë të matur ta bënin këtë gjë. Dhe kjo duket se e ka një shpjegim. Atrofizimi i prokurorisë dhe gjyqësorit nëpërmjet steriotipizimit të tyre është kthyer në alibinë më ‘bajate’ të klasës politike. Të krijohet ideja se gjykatat dhe prokuroria kur bëhet fjalë për dosje politike konvertohen lehtë në komisione parlamentare. Por shoqëria tashmë duket se e ka kuptuar mirë këtë mekanizëm. Jo pa qëllim, në shumicën e raporteve të ndërkombëtarëve, gjyqësori renditet si një ndër institucionet më të korruptuara sipas perceptimit të shoqërisë shqiptare dhe jo vetëm kaq.
Në mënyrë të habitshme, e gjithë klasa politike gulfon për nevojën e reformimit të tij por nga ana tjetër, në mënyrë paradoksale, dështimin e reformave e lidh me mungesën e dëshirës politike kryesisht të opozitës. Pra, sipas kësaj logjike është klasa politike e vetme ajo që menaxhon fatet e gjyqësorit dhe ky i fundit duket të ketë pak përgjegjësi në këtë derivat të komplikuar. Megjithatë literatura sugjeron se edhe gjyqtarët kanë pjesën e tyre të ‘luanit’ dhe fenomeni shqiptar duket se e reflekton këtë situatë. Vetë steriotipizimi i gjyqësorit në shoqëri nga politika dhe deri diku mos reagimi ndaj këtij fenomeni nga komuniteti i gjyqtarëve është shqetësues. Gjyqësori përveç pavarësisë ndaj pushteteve të tjera duhet të rishikojë dhe pavarësinë apo distancimin nga ajo pjesë e vogël e gjyqtarëve të korruptuar. Pavarësia e gjyqësorit sipas filozofëve dhe studiuesve të së drejtës është sa institucionale aq edhe personale.
Një gjyqësor i pavarur shprehet Irvin Stozky, përveç faktorëve klasike, në lidhje me shoqëritë në tranzicion, është një mekanizëm shumë i rëndësishëm sigurie. Me pak fjalë, ai nënkupton se cungimi i lirisë së gjyqësorit lidhet drejtpërsëdrejti me cenimin e sigurisë sociale. Pavarësia e gjyqësorit, është tregues i maturimit politik dhe zhvillimit të demokracisë do të thoshte Christofer Larkins. Një ndër indikatorët më të rëndësishëm për zbatimin e parimeve të shtetit ligjor është funksionimi normal i gjyqësorit. Në kuptimin klasik ai është organi i tretë ‘neutral’ si në çështjet me karakter privat, por dhe në ato me karakter publik. Sistemi gjyqësor sipas Owen Fiss nuk duhet të jetë një mjet për të arritur qëllime politike. Filozofi i njohur Amerikan John Rawls e konsideron pavarësinë e gjyqësorit themelin e drejtësisë sociale. Ekonomisti Stefan Voight analizon tek mungesa e pavarësisë së gjyqësorit një handikap të rëndësishëm për zhvillimet ekonomike. Sipas tij pavarësia e gjyqësorit ka një ndikim shumë të rëndësishëm në rritjen e prodhimit te brendshëm bruto (PBB).
Owen Fiss shprehet se përveç sistemeve gjyqësore të pavarura dhe atyre të kontrolluara, zakonisht në demokracitë e reja kemi ‘regjime relativisht të pavarura’. Janë tre elementë kyç të cilat, sipas Christofer Larkins, duhet që të përmbushë një gjyqësor idealist i pavarur:
Së pari, gjyqtarët duhet të sillen si palë ‘neutrale’ në çdo gjykim dhe këtu kemi parasysh pavarësinë nga bindjet personale dhe njohjet me palët.
Së dyti, gjykatësit nuk duhet të ndikohen në gjykim nga ‘pozita’ politike dhe ekonomike e palës në proces.
Së treti, pavarësisë së gjyqësorit si institucion në raport të drejtë me dy pushtetet e tjera është gjithashtu element shumë i rëndësishëm për t’u konsideruar.
Pra, Owen Fiss cilëson se ‘regjimet relativisht të pavarura’ janë ato në të cilët një nga elementët e mësipërm nuk funksionon. Siç edhe literatura e tregon, pavarësia e gjyqësorit lidhet si me raportin që krijon me pushtetin politik nga njëra anë, por dhe integritetin e vetë komunitetit të gjyqtareve nga ana tjetër.
Sado i garantuar të jetë sistemi gjyqësor nga rregullimet kushtetuese një komunitet gjyqtarësh me mungesë integriteti mund ta cenojë këtë pavarësi. Zakonisht kjo shfaqet në gjykatat e nivelit të ulët. Nga ana tjetër, sado me integritet të jenë gjykatësit, nëse dy pushtetet e tjera minimizojnë rolin e gjyqësorit si institucion, pavarësia në gjykim është e cenuar sërish. Kjo zakonisht ndodh në gjykatat e nivelit të lartë. Pra, pavarësia e gjyqësorit varet nga dy aktorë të cilët janë pushteti politik dhe vetë gjyqtarët. Fenomeni shqiptar duket se vuan nga të dyja drejtimet dhe këtë e shohim në retorikët publike sa të klasës politike, por dhe të vetë komunitetit të gjyqtarëve. Disa ‘aksione’ të ndërmarra nga shoqatat e gjyqtarëve apo dhe ajo e prokurorëve duket se nuk e kanë arritur qëllimin e duhur. Indiferenca dhe apatia e gjyqësorit ngelet shqetësuese dhe kjo e ka një arsye.
Në rastin tonë, elita politike shqiptare, duke abuzuar me mekanizmat dhe nocionet moderne të shtetit ligjor në mënyrë permanente, ka steriotipizuar gjyqësorin direkt apo indirekt. Pikërisht vetë dora e fortë e politikës në formimin, përzgjedhjen, emërimin dhe mbikëqyrjen e gjyqtarëve duket të ketë sjellë formimin e steriotipeve për gjyqtarët në shoqëri, por në një fare mënyre dhe ambientimin e tyre me këtë situatë. Steriotipe si ‘gjykatës plepash’, ‘gjykatësit të shohin xhepin’, ‘po nuk njohe njëri në gjykatë mos u lodh kot’, ‘zgjidh avokat që njeh gjykatësin’, ‘po s’dhe lekë nuk ke për ta fituar të drejtën’ ‘dosjet e krimit flenë në prokurori’ etj. Janë kthyer në zhargon për këdo që merret me gjykatat. Sigurisht, jo pak rol kanë luajtur disa reforma si ajo e kualifikimeve pilot, nëse quhen të tilla, për 6-muaj të gjykatësve apo dhe zvarritjet në lidhje me ligjet organike përkatëse. Viktimë e kurtheve politike ka rënë jo pak herë dhe vetë shoqëria e cila shpesh herë ngatërron rolin e gjyqtarit të korruptuar me atë të avokatit të korruptuar. Media në të njëjtin spektër të kritikës ndaj gjyqësorit, shpesh herë dhe me të drejtë, ka amplifikuar nivelin e korrupsionit në gjyqësor duke krijuar kështu një rreth vicioz i cili cungon personalitetin e gjyqësorit. Kjo i shërben vetëm elitës politike dhe krimit të organizuar që duket se ka gjetur terren edhe në komunitetin e gjyqtarëve. Për t’u fshehur pas gishtit, klasa politike, tashmë rëndomtë, drejton akuzat ndaj gjyqësori apo prokurorisë si fajtorët kryesorë për eficencën e ulët në luftën kundër korrupsionit dhe krimit të organizuar. Tashmë kjo retorikë po kthehet në një alibi shumë të suksesshme.
Steriotipizimi i gjyqësorit pra, duket se ka funksionuar duke bërë që gjyqësori të jetë shumë apatik dhe jo i drejtpërdrejt ndaj akuzave që i bëhen. Gjyqtarët dhe prokurorët duket sikur kanë rënë viktimë, deri diku dhe me dashje, e këtij procesi neutralizues. Shumë vendime gjykatash të dyshimta të cilat lidhen me figura të larta politike tregojnë sa inferior ndihen gjykatësit apo dhe prokurorët ndaj pushtetit politik. Tashmë përbën lajm një vendim gjykate kundër ndonjë aktori politik dhe jo e kundërta. Fatkeqësisht, duket se ekziston një pakt paqeje i heshtur midis politikës dhe gjyqësorit. Deri më sot nuk kemi asnjë figurë të lartë politike të dënuar, por nga ana tjetër edhe gjyqtarët e proceduar për korrupsion janë shumë të pakët. Steriotipizimi çon deri aty sa të krijohet përshtypja se në sistemin gjyqësor, janë vetë gjyqtarët që kërkojnë një situatë të mjegullt e cila do t’i ndihmonte për të justifikuar ineficencen e tyre apo dhe nivelin e lartë të korrupsionit.
Vetë konferenca e gjyqtarëve dhe pjesëmarrja e ulët në të evidenton se sistemi gjyqësor është i apatik duke ia dorëzuar çdo lloj reforme elitës politike. Duhet kuptuar se gjyqësori është një ndër tre pushtetet i cili kontrollon dhe balancon dy pushtetet e tjera. Në demokracitë e reja si kjo e jona, askush nga forcat paralele siç janë legjislativi dhe ekzekutivi nuk do të dëshironte apriori një gjyqësor të fortë. Kjo në Shqipëri është evidentuar për më se dy dekadash. Sistemi gjyqësor duhet të jetë promotori i reformave që lidhen me të, duke i vënë një theks të veçantë integritetit të gjyqtarit. Vendimet e drejta dhe në zbatim të ligjit duke mos pasur parasysh pozitën sociale apo politike të palëve do t’i jepnin kredibilitetin dhe respektin e munguar gjykatës shqiptare. Vetëm atëherë çdo reformë e iniciuar prej tyre apo reagim ndaj ndërhyrjeve të politikës do të mirëpriteshin nga shoqëria.
Me pak fjalë në një shoqëri ku gjyqësori është i varur jo vetëm institucionalisht, por dhe nga mungesa e integritetit të gjyqtarëve, dilemat e demokracisë dhe shtetit ligjor mbeten krejtësisht të hapura. Një gjyqësor i kontrolluar i jep mundësi qarqeve politike që në rastin e Shqipërisë duket të jenë të konturuara mirë me elitat ekonomike, të ngelen jashtë kontrollit ligjor. Duket se ka një steriotipizim të qëllimshëm të sistemit gjyqësor i cili fatkeqësisht ka arritur me sukses të dobësojë rolin e gjykatës shqiptare. Kjo nuk e ndihmon gjyqësorin, por përkundrazi ia vështirëson atij proceset reformuese. Të neutralizosh gjyqësorin do të thotë të neutralizosh mekanizmin kryesor mbrojtës të kushtetutës dhe lirive të qytetarëve, dhe në këtë pikë fatkeqësisht elita politike nuk është e vetmja fajtore. Pra, faji nuk duhet kërkuar vetëm tek roli aktiv i politikes për ta neutralizuar gjyqësorin, por edhe tek roli pasiv i këtij të fundit për të reaguar.

Pse u qëllua gjyqtari?

Korrupsioni, reformat institucionale, zgjedhjet, apo dhe një mori termash tashmë rëndom në raportet e ndërkombëtarëve, por dhe në shtypin apo dhe retorikën politike zënë përqindjen më të madhe të konsumit verbal të së përditshmes shqiptare. Procesi i tranzicionit shqiptar përveç se politik apo ekonomik, mbi të gjitha duket se do të kërkojë kohë në ndjesinë e shqiptarëve ndaj institucioneve dhe rolit të tyre. Shumë analistë ndajnë mendime të ndryshme me proceset transformuese të institucioneve shtetërore në pjesën post-komuniste të Europës. Dhe tek gërmon ndër terma apo definicione, ajo që ndodh në Shqipërinë tonë luhatet midis revolucionit dhe evolucionit institucional, ose më saktë mbase diçka midis të dyjave. Nëse me revolucion strukturash shtetërore do të kuptonim një ndryshim thelbësor teorik, por dhe praktik të botëkuptimit dhe funksionimit të shtetit, evolucioni do t’i referohej më shumë një ndryshimi gradual pa ndërtime mbi gërmadha, por një rafiniturë e së djeshmes me një luk të ri. Tek ne i gjen të dyja, por ç’është më e keqja pjesa evoluese që do të duhej të ndodhte në procesin institucional ndodh me kastën politike, ku evoluimi është thjesht sipërfaqësor, jo i mbështetur në doktrina, por në retorika reklamash pragzgjedhjesh. Pra një proces gjysmak reformimi i botëkuptimit të klasës politike, reflektohet dërmueshëm në një shoqëri tek e cila sheh çdo gjë institucionale si politike dhe duke qenë se politika sot ekuivalentohet me përvetësim interesash apo korrupsion, çdo akt institucional apo me burim prej tij vihet në dyshim. Kështu dhe me gjyqësori. Ngjarja makabër e plumbave të zbrazur ndaj anëtarit të Gjykatës së Lartë ngre disa pikëpyetje të mëdha me atë se çfarë ndodh sot me drejtësinë dhe perceptimin e shoqërisë për rolin e saj. Këto plumba janë plumba mbi institucionet, janë plumba mbi shtetin ligjor, janë plumba arkaikë, janë plumba të cilët duhet të shqetësojnë thellë ndërgjegjen qytetare, lëre më atë politike. Ky akt tregon fatkeqësisht katandisjen e statusit të atyre që në shoqëritë moderne gëzojnë respektin maksimal për shkak të pozicionimit të tyre sa institucional, por dhe shoqëror. Është fatkeqësi sesi figura e gjyqtarit lakohet sot vetëm me terma tregu, sikur vendimet e gjykatës të jenë mall pazari dhe jo verdikte për përcaktimin dhe mbrojtjen e të drejtave të atyre që u është marrë apo përvetësuar padrejtësisht kjo e drejtë. Janë të dhimbshme kushtet në të cilat organizohet, funksionon dhe jepet e drejta në një vend që aspiron të jetë apo është pjesë e strukturave moderne institucionalë ndërkombëtare. Akoma dhe më e turpshme sesi negociohet e drejta dhe sesi manipulohet ajo. Pa hyrë në arsyet e kësaj ngjarje, gjë që do t’i takojë organeve përkatëse, kushdo të kenë qenë ato, ky akt na bën të ndihemi popull fatkeq. Zgjidhja personale apo vetëvendosja si formë e zgjidhjes së problemit në vend të zgjidhjeve institucionale, është sot reforma kryesore që duhet të ndërmarrë kasta politike e kujtdo spektri qoftë. Humbja e besimit të shoqërisë në institucionet e saj është thelbi i ngërçit më të madh të një zhvillimi sa social, por dhe kulturor në një shoqëri moderne. Kuptimi i shtetit ligjor do të ishte thjesht një frazë e përkthyer keq nëse institucionet do të ishin mjet shfrytëzimi dhe jo operimi në dinamikën e zhvillimeve ekonomike, por dhe politike të vendit. Duke qenë se politika shqiptare, procesin reformues të institucioneve në përgjithësi dhe atij të gjyqësorit në veçanti e sheh si një betejë interesash apo pushteti të politikbërësve, janë vetë gjyqtarët ata të cilët duhet të sigurojnë status quon e tyre nëpërmjet integritetit personal dhe ruajtjes së pavarësisë ndaj politikës apo dhe krimit të organizuar. Nga ana tjetër vetë shoqëria reagimin e saj duhet ta konturojë dhe drejtojë tek mjetet ligjore dhe jo në veprime banale apo kriminale.
Ajo që duhet kuptuar është se sa më të dobëta institucionet, aq më të pakta shanset për një shkëputje nga një tranzicion kaq afatgjatë. Dhe njëherë ajo shoqëri që derdh plumba ndaj institucioneve të saj tregon se është në krizë të lartë depresioni social, por dhe politik, fajtor për të cilat mbase jemi të gjithë.

Drug money saved banks in global crisis, claims UN advisor

Drugs and crime chief says $352bn in criminal proceeds was effectively laundered by financial institutions

Drugs money worth billions of dollars kept the financial system afloat at the height of the global crisis, the United Nations' drugs and crime tsar has told the Observer.

Antonio Maria Costa, head of the UN Office on Drugs and Crime, said he has seen evidence that the proceeds of organised crime were "the only liquid investment capital" available to some banks on the brink of collapse last year. He said that a majority of the $352bn (£216bn) of drugs profits was absorbed into the economic system as a result.

This will raise questions about crime's influence on the economic system at times of crisis. It will also prompt further examination of the banking sector as world leaders, including Barack Obama and Gordon Brown, call for new International Monetary Fund regulations. Speaking from his office in Vienna, Costa said evidence that illegal money was being absorbed into the financial system was first drawn to his attention by intelligence agencies and prosecutors around 18 months ago. "In many instances, the money from drugs was the only liquid investment capital. In the second half of 2008, liquidity was the banking system's main problem and hence liquid capital became an important factor," he said.

Some of the evidence put before his office indicated that gang money was used to save some banks from collapse when lending seized up, he said.

"Inter-bank loans were funded by money that originated from the drugs trade and other illegal activities... There were signs that some banks were rescued that way." Costa declined to identify countries or banks that may have received any drugs money, saying that would be inappropriate because his office is supposed to address the problem, not apportion blame. But he said the money is now a part of the official system and had been effectively laundered.

"That was the moment [last year] when the system was basically paralysed because of the unwillingness of banks to lend money to one another. The progressive liquidisation to the system and the progressive improvement by some banks of their share values [has meant that] the problem [of illegal money] has become much less serious than it was," he said.

The IMF estimated that large US and European banks lost more than $1tn on toxic assets and from bad loans from January 2007 to September 2009 and more than 200 mortgage lenders went bankrupt. Many major institutions either failed, were acquired under duress, or were subject to government takeover.

Gangs are now believed to make most of their profits from the drugs trade and are estimated to be worth £352bn, the UN says. They have traditionally kept proceeds in cash or moved it offshore to hide it from the authorities. It is understood that evidence that drug money has flowed into banks came from officials in Britain, Switzerland, Italy and the US.

British bankers would want to see any evidence that Costa has to back his claims. A British Bankers' Association spokesman said: "We have not been party to any regulatory dialogue that would support a theory of this kind. There was clearly a lack of liquidity in the system and to a large degree this was filled by the intervention of central banks."

Sometimes the exposure of a hidden truth changes the course of history.

A White House tape, recording the US president six days after the Watergate break-in, sealed President Nixon's fate, forcing his resignation within weeks. Aleksandr Solzhenitsyn's The Gulag Archipelago, smuggled out of the USSR and published in 1973, shocked the world by describing the vast Soviet system of prison labour. Throughout history, those in power have kept secrets hidden from the public eye. But if it leads to a culture of impunity for crimes committed by the state, secrecy becomes dangerous. A culture of impunity thrives on secrecy, and on complicit media and a passive civil society.

In Turkey, both secrecy and impunity for those defending the state against its enemies at home and abroad were long taken for granted. Attempts to cast light on the activities of groups and institutions referred to as the "deep state" (derin devlet) have invariably failed. Some have even questioned whether the deep state really exists.

Recent weeks have seen the Turkish veil of secrecy drawn aside in a spectacular manner. Two documents have emerged which describe, in detail, operations planned by members of the Turkish armed forces to terrify, frame and even assassinate innocent civilians, Christians or Muslim students, and undermine the elected government.

One document is called Operation Cage (Kafes) Action Plan. The other is the Action Plan to Combat Reaction – Current Status. Each of these documents in itself, but even more so when read together, deals a serious blow to the credibility and legitimacy of the Turkish security structures. Both have come to light as a result of the current Ergenekon court case. The case has involved Istanbul prosecutors investigating a range of alleged crimes committed by groups linked to the Turkish security structures with the apparent intent to topple the elected government.

An electronic copy of the Cage Plan was found – encrypted - on a CD seized in April 2009, when a former member of the Turkish Underwater Assault Team of the Naval Forces was arrested. A signed copy of the Reaction Plan was found during the arrest of another former military officer in June 2009. The Turkish General Staff immediately dismissed it as fake, a mere "piece of paper." The Chief of the General Staff even alleged a conspiracy against the military. Then, in October 2009, a whistleblower within the General Staff sent the original signed copy of the Reaction Plan to a Turkish prosecutor, together with a letter explaining the role of the former Deputy Chief of the General Staff in drawing up the plan. This was made public on 24 October. The Cage Plan was made public on 19 November in an article in the Taraf daily.

What makes these two documents so explosive?

The Cage Plan is remarkably specific. There is a date on it: March 2009. There is the name of the author: Ercan Kirectepe, Naval Officer, Acting Special Operations Force Command. The Plan sets out a distribution of tasks among some 35 members of the Navy, under a consultative assembly presided over by Vice Admiral Feyyaz Ogutcu. And there is a clear, concrete target:

"to increase both internal and external pressures on the AKP Government, to keep the public preoccupied and to change the agenda, particularly the Ergenekon case, by calling into question the safety of the life and property of non-Muslims."

Most chilling of all, there is a list of concrete tasks to be prepared and carried out, including these:

"(d) Operation stage:

(1) Bombs will be detonated at various quarters in the Adalar district/the Princes islands near Istanbul.

(2) Assassinations will be organized against persons known as fierce defenders of minority rights.

(3) Sound bombs will be placed in identified locations such as the vicinity of AGOS Newspaper.

(4) By placing suspicious packages at many spots and informing the police of them, the security forces will be kept preoccupied.

(5) Actions with bombs will be carried out at piers from which boat journeys to Adalar originate.

(6) Sensational operations will be executed towards the cemeteries of non-Muslims.

(7) One or several popular non-Muslim businessmen and artists will be kidnapped.

(8) In regions with a dense non-Muslim population vehicles, houses and workplaces will be set on fire at close intervals.

(9) Similar actions will also be conducted in provinces with a high population of non-Muslims, such as Istanbul and Izmir.

(10) Responsibility for sabotage, kidnapping and assassination operations will be claimed by reactionary organizations. The organisations themselves will be determined by way of coordination with the special plan cell leaders."

The Action Plan against Reaction, signed by a colonel working directly in the Office of the General Staff, defines a similar target:

"To put an end to hesitation over this issue by revealing the hidden face of the religious reactionary elements and to eradicate public support for such networks. To minimize the impact of the erosive campaigns staged in the framework of Ergenekon and to put an end to the negative propaganda against the Turkish Armed Forces."

To achieve this, the Action Plan outlines a set of concrete measures, directed primarily against the conservative Gulen movement that supports both the AKP government and Turkey's EU aspirations:

"The theme, 'Fethullah Gulen supporters are out of control, attacking the Turkish Armed forces head on,' will be pursued and work towards getting even conservative citizens to say 'this is too much, we are all Muslims, but these supporters of Fethullah Gulen are making provocations in order to attack the Turkish Armed Forces' will be carried out."

"During the raids against the addresses of Gulen dormitories (ısık evleri) to be conducted under military law, weapons, ammunitions, plans and other material will be arranged to be found so that the Fethullah Gulen group is described as an armed terrorist organization; Pro-Fethullah Armed Terror Organisation (FATO) investigations will be conducted under military jurisdiction."

"News articles will be written that Turkish Armed Forces staff members arrested under Ergenekon investigation are innocent and that they are slandered just because they effectively fight reactionary Islam."

Pro-European Turkish media, above all the Taraf daily, played a decisive role in uncovering and disseminating such information. Turkey's minority representatives have also been speaking out. On 4 December the Armenian weekly AGOS ran the headline "The Cage did not Surprise us". The Armenian advisor to (CHP) Mayor of Adalar (the Princes islands near Istanbul) stated that "we experienced such incidents in Heybeliada, Kinaliada and Buyukada. We thought these were separate incidents, but when we saw the Cage plan, we understood that they were all part of a detailed plot." Greek Orthodox Patriarch Bartholomew told Zaman daily that dark forces planned to use minorities to overthrow the government, and that "it is a very satisfactory development that the Turkish police and the prosecutors have been revealing those dark plans so the responsible people are captured and tried."

Eyup Can wrote in Hurriyet (21 November) that "if even half of what is written in Taraf is accurate everybody with a conscience in this country has to go mad." Hadi Uluengin noted in the same paper on 24 November that "if this is true, then this is the most terrible conspiracy ever planned within the ranks of the Armed Forces." Independent left-wing MP Ufuk Uras stated that "those who see this and do not write about it become accomplices to that crime." ("Uras: People who ignore Cage Plan are accomplices").

The ongoing Ergenekon investigation will hopefully uncover the full genesis of these documents. Only a court of law can determine the guilt of any specific individual. But the debates surrounding documents are already changing Turkey. In July, a new law passed by the Turkish Parliament extended the power of civilian courts to try crimes committed by both former and active members of the military. And last week three retired four-star generals were for the first time interrogated by civilian prosecutors on alleged coup plots in 2003-2004.

The silent revolution in Turkish civil-military relations is in full swing.

Albanian General Prosecutor Ina Rama has called for a constitutional amendment that would restrict the immunity of judges, in order to strengthen the fight against corruption in the judiciary.
“It's problematic because [while] prosecutors can be investigated without hassles, we don't have the possibility to investigate judges, who are granted immunity by the constitution,” Rama said on Thursday at a conference on judicial reform.

“If the General Prosecutor's Office seeks the authorisation to investigate a judge on corruption-related charges, the investigation has already become public and it its difficult to move forward,” she said, adding: “It's not possible to investigate a judge on corruption, if he knows that he is being investigated.”

Rama also spoke out against corporatism in the judicial system, illustrating her argument with cases where prosecutors arrested on corruption charges were set free by the courts.

According to the 2009 European Commission progress report, judicial reform in Albania remains in its early stages, with little progress made thereon in the last year.

“Key pieces of legislation needed to complete the legal framework have not been adopted and the justice system continues to function poorly due to shortcomings in independence, transparency and efficiency,” the report found.

Bulgaria Chief Prosecutor, Boris Velchev, has stated that the full list of people who have been in contact with “Krasio from Pleven’ will be published in a few days time.

Velchev, speaking after attending the Bulgarian Parliament, said that with the help of the State National Security Agency (DANS) the list would be published to stop speculation as to who is in Krasio’s little black book.

Bulgaria's Supreme Judicial Council (VSS) earlier announced the names of five new magistrates, who have been in contact with the famous businessman ‘Krasio from Pleven’.

Tsoni Tsonev, the Chairman of the corruption commission at VSS, stated late Wednesday that the total number of magistrates who have liaised with ‘Krasio’ had now been confirmed as 18.
